THIS CONTEST IS OPEN TO LEGAL RESIDENTS OF CANADA AND IS GOVERNED BY CANADIAN LAW. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
By taking part in this Contest you accept and agree to be legally bound by these Contest official rules (“Official Rules”) and agree that all decisions of Sponsor (as defined below) are final and binding. These Official Rules apply only to this Contest and not to any other promotions, contests, or sweepstakes sponsored by New Era (as defined below). The Official Rules are at www.crownthechamps.ca throughout the Contest Period (as defined below).
SPONSOR: This Contest is sponsored by New Era Cap Company, 6205A Airport Road, Suite 102, Mississauga, Ontario L4V 1E1 (“New Era” or “Sponsor”).
CONTEST PERIOD: The “NEW ERA CROWN THE CHAMPS” (the “Contest”) begins at 9:00 a.m. Eastern Time (“ET”) on September 16, 2019 and ends at 11:59 p.m. ET on October 21, 2019 (the “Contest Period”).
ELIGIBILITY, RESIDENCY AND AGE: The Contest is only open to legal residents of Canada who are nineteen (19) years of age or older as of the date they entered the Contest during the Contest Period (“Entrant” or “Entrants”). Despite the foregoing, employees, officers, directors of the Sponsors, CFL Entities (as defined below), representatives and/or agents (as well as their respective immediate family members [i.e. husband, wife, spouse, partner, mother, father, brothers, sisters, sons and/or daughters] (regardless of where they live and anyone domiciled with them whether related to them or not) of the Sponsor, and its parents, affiliates, subsidiaries, advertising and promotion agencies and/or any other entity involved in the administration, execution or fulfillment of the Contest (collectively, “Contest Parties”) are not eligible to enter the Contest or win the Prize (as defined below). Sponsor reserves the right to verify the eligibility of any Entrant at any time. The Contest is subject to all federal, provincial, territorial and municipal laws and regulations and is void where prohibited by law.
HOW TO ENTER: NO PURCHASE NECESSARY. To enter go to www.crownthechamps.ca (the “Website”) during the Contest Period, follow the on-screen instructions to obtain the Official Contest Entry Form (the “Entry Form”), fully complete the Entry Form with all required information, which may include a requirement to: (i) enter your first name, last name, email address, age, mobile telephone number, full mailing address (including street address, city, province, postal code); (ii) select your favourite CFL team (from among the list of teams provided); and (iii) signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Official Rules. To complete an entry, fans will be prompted to follow both CFL & New Era Facebook/Instagram accounts. Once you have fully completed the Entry Form with all required information and have agreed to the Official Rules, follow the on-screen instructions to submit your completed Entry Form (a “Main Entry”). To be eligible, your Main Entry must be submitted and received in accordance with these Official Rules during the Contest Period (as determined by the Sponsor in its sole and absolute discretion on the basis of its official records).
If you opt to use Instagram, Facebook or Twitter via your wireless mobile device (which may only be available via participating wireless carriers and is not required to enter the Contest), standard text messaging and/or data rates may apply for each message sent or received from your handset according to the terms and conditions of your services agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers’ rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Contest. Participation in this Contest by mobile device means that you understand that you may receive additional messages by mobile device relating to this Contest, including notifying you if you are the potential Prize winner, which may be subject to charges pursuant to your carrier’s rate plan. Text messaging may not be available from all mobile phone service carriers and handset models. Mobile device service may not be available in all areas. Check your phone’s capabilities for specific instructions.
All entries are subject to verification. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s).
PRIZES: There are multiple tiered prizes packs to be won.
Each First Tier Prize Package shall consist of:
- One (1) CFL team cap & one (1) CFL T-shirt. Approximate retail value (“ARV”) $80 each.
- There will be up to 9 winners of the First Tier Prize Package. each.
Each Second Tier Prize Package shall consist of:
- One (1) CFL team knit hat & one (1) smartphone accessory. ARV $55 each.
- There will be up to 6 winners of the Second Tier Prize Package.
Each Third Tier Package shall consist of:
- One (1) ticket for the Prize winner and one (1) ticket for a guest (“Guest”) to attend the CFL Grey Cup final game (the “Game”) in Canada that will take place on November 24, 2019 in Calgary, Alberta;
- $500.00 CAD in spending money (awarded to each Third Tier Finalist (as defined below) only, and not to Guest);
- Round-trip air transportation (coach class) for the Third Tier Finalist and his/her Guest, to be used exclusively for the purpose of attending the Game (“Flights”). Flights shall depart from a major Canadian airport nearest to the Prize winner’s residence; and
- A maximum of (2) night’s accommodation (one room, double occupancy) for Third Tier Finalist and his/her Guest in a standard hotel (as selected by the Sponsor in its sole and absolute discretion).

- There will only be one (1) Fourth Tier Finalist and winner of the Fourth Tier Prize package. ARV $0.
TIER ONE PRIZE WINNER SELECTION, STAGE 1 (SHORTLIST VIA RANDOM DRAW): On October 21, 2019 in Toronto, Ontario at 1:00 p.m. ET in Toronto, Ontario, all eligible Entries submitted and received in accordance with these Official Rules during the Contest Period will be placed into nine (9) pools based on the favourite CFL Team as selected by the Entrant on their Entry Form. Twelve (12) Entrants will be selected by a random drawing from each of the nine pools and each such selected Entrant will be deemed a finalist (each, a “Shortlist Finalist”). The odds of being selected as a Shortlist Finalist depend on the number of eligible Entries submitted for each CFL Team in accordance with these Official Rules during the Contest Period.
SHORTLIST NOTIFICATION AND VIDEO SUBMISSION: The Sponsor or its designated representative will make a minimum of 3 attempts to contact each Shortlist Finalist (using the information provided on his/her Entry Form) on October 22, 2019. If a Shortlist Finalist does not respond before October 23 at 11:59 p.m. ET, or if there is a return of any notification as undeliverable, then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate Shortlist Finalist from among the remaining Entries in the same entry pool where the disqualified Shortlist Finalist was selected from (in which case the foregoing provisions of this section shall apply to such newly selected Finalist).
Following notification, each selected Shortlist Finalist will be required to submit an original video (maximum 30 seconds long) (a “Video”) that: (i) describes (a) the Finalist’s personal journey to 1) how they became an CFL fan, and 2) what makes a New Era different than the rest; and (ii) complies with the Video Requirements provided below. In order to be eligible, a Video must be submitted in accordance with the Sponsor’s instructions (for example, the Video may be submitted via text message or email using the information provided by the Sponsor) by October 27, 2019 at 5:00 p.m. ET.
VIDEO REQUIREMENTS: Each Shortlist Finalist warrants and represents that his/her Video:
- is original to him/her and that the Shortlist Finalist has all necessary rights (including, without limitation, consent of the videographer) in and to the Video to enter the Contest;
- does not violate any law, statute, ordinance or regulation;
- does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals, as well as their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;
- will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
- is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
- Explicit, graphic or excessive sexual activity;
- Crude, vulgar or offensive language and/or symbols;
- Derogatory characterizations of any ethnic, racial, sexual or religious groups;
- Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behavior or conduct;
- Personal information of individuals, including without limitation, names and addresses (physical or e-mail);
- Conduct or other activities in violation of these Official Rules;
Commercial messages, comparisons or solicitations for products or services other than those of Sponsor;
- Any identifiable third party products and/or trade-marks, brands or logos. For example, any clothing worn by persons appearing in a Video must not contain any visible logos, trade-marks or other third party materials, unless the necessary permissions/licenses have been obtained; and
- Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.
By submitting the Video, each Shortlist Finalist: (i) grants to the Sponsor, in perpetuity, a world-wide, non-exclusive license to publish, display, reproduce, modify, edit, communicate to the public by telecommunication and otherwise use and exploit the Video, in whole or in part, for advertising or promoting the Contest (and similar contests), the Contest Parties and/or for any other reason; (ii) waives all moral rights in and to his/her Video in favour of the Released Parties; and (iii) agrees to release and hold harmless the Released Parties against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other cause of action.
TIER 1 PRIZE WINNER SELECTION, STAGE 2 (SELECTION OF WINNER VIA JUDGING): A panel of judges (the “Judges”) appointed by the Sponsor at its sole and absolute discretion will judge and assign a score (each, a “Score”) to each Shortlist Finalist’s Video on the basis of the following equally-weighted criteria (the “Judging Criteria”):

The Shortlist Finalist whose Video obtains a higher Score than the other eleven (11) Shortlist Finalist selected from their respective pool (based on their favourite CFL Team) will be selected as the First Tier Prize winners (each, a “Tier One Finalist”). The odds of winning from among the Shortlist Finalists depend on the calibre (based on the Judging Criteria) of the Shortlist Finalists’ respective Videos. In the event of a tie between two Shortlist Finalists based on Score, the Shortlist Finalist associated with the Video with the highest score on the question of ‘What makes a New Era different than the rest’ criterion listed above will be deemed to have obtained the higher Score. Judging is scheduled to be completed on or about October 23, 2019 (the “Selection Date”). The nine (9) Tier One Finalists will each receive the Tier 1 Prize Package.
TIER TWO PRIZE WINNER SELECTION On November 4, 2019 in Toronto, Ontario at 1:00 p.m. ET in Toronto, Ontario, six (6) of the Tier One Finalists will be selected in correlation to which CFL teams make the playoffs (each, a “Tier Two Finalist”). The odds of being selected as a Tier Two Finalist depend on the outcome of CFL game play. The six (6) Tier Two Finalists will each receive the Tier 2 Prize Package.
TIER THREE PRIZE WINNER SELECTION On November 18, 2019 in Toronto, Ontario at 1:00 p.m. ET in Toronto, Ontario, two (2) of the Tier Two Finalists will be selected in correlation to which CFL teams make the 107th Grey Cup (each, a “Tier Three Finalist”). The odds of being selected as a Tier Three Finalist depend on the outcome of CFL game play. Each Tier Three Finalists will receive the Tier 3 Prize Package and watch the Grey Cup.
The Tier Three Finalist whose favourite CFL Team as listed on the Entry Form wins the Grey Cup will receive the Tier 4 Prize Package (the “Tier Four Finalist”). The odds of being selected as a Tier Four Finalist depend on the outcome of CFL game play.
The Shortlist Finalists, Tier One Finalists, Tier Two Finalists, Tier Three Finalists and Tier Four Finalist will be collectively referred to as the “Finalists”.
IMPORTANT NOTE: Each Finalist and his/her Guest (if applicable) will be filmed, photographed and otherwise recorded while participating in the Prize and the Contest (collectively, the “Recordings”). The Recordings will be reproduced, published, communicated to the public by telecommunications and otherwise exploited (alone or with other content, as is or as may be edited) by the Contest Parties worldwide, in perpetuity, in any media and for any purpose (including without limitation promoting the Contest Parties on social medial platforms). The costs of everything not stated above as included in the Prize are the responsibility of the winner, and without limiting the generality of this statement, the following costs are the responsibility of the winner: transportation from the winner’s residence to the departure airport, gratuities, health insurance, travel insurance, items of a personal nature, transportation between the airport and the hotel and for any and all other expenses related to their acceptance and participating in the Prize. Each Tier Three Finalists and his/her Guest must have all necessary documents and identification to travel. It is recommended that each Tier Three Finalists and his/her Guest obtain sufficient personal, medical and travel insurance prior to departure. A minimum of one person per group, either the Tier Three Finalist or his/her Guest, must hold a valid credit card to cover any incidentals or any other requirement that may be required at the hotel.
Each Tier Three Finalist and his/her Guest must be nineteen (19) years of age or older and will be required to sign and return, within 2 business days of notification of becoming a Tier Three Finalist, the Sponsor’s declaration and release form, which (among other thing): (i) releases the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with his/her participation, acceptance, use or misuse of the Prize and participation in the Prize and any Prize-related activities; and (ii) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements (which may be about the Contest, the Prize or the Sponsor) and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Contest Parties worldwide, in perpetuity in any manner or medium whatsoever, including without limitation as it may appear in the Recordings. Failure to timely return the declaration and release form shall result in disqualification for the Finalist and/or his/her Guest (as determined by the Sponsor in its sole and absolute discretion).
The following further terms and conditions apply to the Prize: (i) each Tier Three Finalist and his/her Guest must travel on same itinerary, (ii) if any Finalist does not utilize any aspects of the Prize, such aspects will be forfeited in their entirety and nothing will be substituted in their place, (iii) all travel and hotel arrangements may only be made by the Sponsor, (iv) each Tier Three Finalist and his/her Guest must appear in the Recordings in accordance with the Sponsor’s instructions, (v) each ticket is subject to the terms and conditions of the issuer and seat selection is at the sole and absolute discretion of the Sponsor (and, for greater certainty, each Tier Three Finalist and his/her Guest will not be guaranteed to watch the Game from the sidelines), (vi) the Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (vii) neither Sponsor nor any of its Prize suppliers will replace any lost or stolen tickets, (viii) any difference between the actual value of the Prize and its stated approximate retail value will not be awarded, (ix) all characteristics and features of the Prize (and of each Prize element), except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion, (x) precise travel arrangements are subject to space and flight availability and shall be made at the Sponsor’s sole and absolute discretion, (xi) once booked, travel arrangements may not be changed by either Tier Three Finalist or his/her Guest, (xii) certain blackout dates and further restrictions may apply, (xiii) the Released Parties will be in no way responsible in the event that any part of the Prize (including without limitation the Game) is delayed, cancelled, postponed or rescheduled for any reason whatsoever, and (xiv) Sponsor is not responsible in the event either Tier Three Finalist and/or his/her respective Guest are unable to travel for any reason, in which case, the Prize will be forfeited and nothing will be provided in its place. The Prize cannot be transferred by the selected Finalist. By accepting the Prize, the winner agrees to maintain his/her behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest or Prize-related activity, including, without limitation, attending the Game. The winner understands and agrees that Sponsor or Prize providers have the right, in their sole and absolute discretion, to disqualify and remove the winner and/or his/her Guest from any activity at any time if the winner’s or his/her Guest’s behavior at any point is uncooperative, disruptive, or may or does cause damage to any person, property, or the reputation of Sponsor or otherwise violates the policies of the Prize providers.
GENERAL CONDITIONS: By entering the Contest, Entrants agree to be bound by these Official Rules and agree: (1) that the Released Parties (listed above) may use (unless prohibited by law) the entrant’s name, voice, province/territory of residence, photograph, visual and/or audio likeness for advertising and/or trade purposes, and for any other purpose in any media or format now or hereafter known without further compensation, permission or notification; and (2) to release and hold harmless the Released Parties from any and all liability for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with (1) participation in this Contest; (2) possession, acceptance and/or use or misuse of the Prize (if applicable); (3) participation in any Contest-related activity, including but not limited to injury at the Game or travel to-and-from the Game; and (4) any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.
INDEMNIFICATION AND LIMITATION OF LIABILITY: WITHOUT LIMITING THE GENERALITY OF THE FOREGOING AND FOR GREATER CERTAINTY, BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE OF ANY PRIZE THAT MAY BE WON. THE SPONSOR DOES NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE.
THE RELEASED PARTIES DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM OR MOBILE DEVICE RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.
ADDITIONAL TERMS: The Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, which may occur in this Contest.
Contest-related information that does not conform with these Official Rules (as determined by the Sponsor in its sole and absolute discretion) will be disqualified. Any false information provided by an Entrant in connection with this Contest (e.g. in respect of their identity, age, mailing address, etc.) is grounds for disqualification (as determined by the Sponsor in its sole and absolute discretion). Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest. Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.
The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Official Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules. Any attempt to deliberately damage any website (including without limitation the Website) or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Official Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind, or for any other reason. No more than the stated number of each Prize will be awarded.
In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules or other statements contained in any Contest-related materials, including, but not limited to the French version of these Official Rules, the terms and conditions of these English Official Rules shall prevail, govern and control.
For Quebec residents only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
DISPUTES: This Contest is governed by the laws of the province of Ontario and the federal laws of Canada therein without respect to conflict of law doctrines. As a condition of participating in this Contest, the Entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court of competent jurisdiction located in the Province of Ontario. Further, in any such dispute, and to the full extent permissible by law, under no circumstances shall the Entrant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the Entrant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Entrants further waive all rights to have damages multiplied or increased, to the full extent permissible by law.
